1. Acceptance of Terms

Welcome to Philippines Wellness Retreats. By accessing our website, booking our services, or participating in our wellness programs, you agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legal agreement between you ("Guest," "you," or "your") and Philippines Wellness Retreats ("Company," "we," "us," or "our").

If you do not agree with any part of these Terms, please do not use our services. We reserve the right to modify these Terms at any time, and your continued use of our services constitutes acceptance of such changes.

2. Service Descriptions

2.1 Wellness Retreat Programs

Philippines Wellness Retreats offers comprehensive wellness experiences including:

• Yoga and meditation sessions
• Spa and holistic healing treatments
• Detoxification and cleansing programs
• Spiritual and mindfulness retreats
• Nature immersion and eco-therapy
• Accommodation and organic meal services
• Transportation and guided excursions

2.2 Service Modifications

We reserve the right to modify, substitute, or cancel any aspect of our programs due to weather conditions, instructor availability, health regulations, or other circumstances beyond our control. We will provide reasonable alternatives when possible and notify guests as soon as practicable.

3. Booking and Reservations

3.1 Booking Process

• All bookings must be made through our official website or authorized agents
• Bookings are confirmed upon receipt of deposit payment
• Full payment is required 30 days before retreat start date
• Confirmation details will be sent via email within 24-48 hours

3.2 Minimum Age and Requirements

• Guests must be 18 years or older unless accompanied by a parent/guardian
• Some programs may have specific age, fitness, or health requirements
• Valid passport required for international guests
• Health questionnaire must be completed before arrival

3.3 Group Bookings

Special rates and terms apply to groups of 8 or more guests. Please contact our reservations team for customized group packages and terms.

4. Payment Terms

4.1 Pricing and Currency

• All prices are quoted in Philippine Peso (PHP) unless otherwise stated
• Prices include accommodation, meals, activities, and specified services
• Additional services, personal expenses, and gratuities are not included
• Prices are subject to change without notice until booking is confirmed

4.2 Payment Schedule

• Deposit: 30% due at time of booking
• Final Payment: 70% due 30 days before retreat start date
• Late Bookings: Full payment required for bookings made within 30 days

4.3 Accepted Payment Methods

We accept credit cards (Visa, Mastercard, American Express), bank transfers, and PayPal. All payments are processed securely through encrypted payment gateways.

5. Cancellation and Refund Policy

5.1 Guest Cancellations

• 60+ days before retreat: Full refund minus 5% processing fee
• 30-59 days before retreat: 75% refund
• 15-29 days before retreat: 50% refund
• 7-14 days before retreat: 25% refund
• Less than 7 days: No refund (except medical emergencies)

5.2 Medical Emergency Cancellations

Cancellations due to serious illness or medical emergencies may be eligible for a 75% refund with proper medical documentation. Travel insurance is strongly recommended to cover unforeseen circumstances.

5.3 Company Cancellations

If we cancel a retreat due to insufficient bookings, natural disasters, or other circumstances beyond our control, guests will receive a full refund or the option to transfer to another retreat program.

5.4 No-Show Policy

Guests who fail to arrive without prior notice forfeit all payments with no refund or credit.

6. Health and Safety

6.1 Health Requirements

• Guests must complete a health questionnaire before arrival
• Certain medical conditions may prevent participation in some activities
• Pregnancy restrictions may apply to certain treatments and activities
• Current vaccinations may be required as per Philippines health regulations

6.2 Physical Activity Participation

Participation in yoga, meditation, hiking, and other physical activities is at your own risk. Please inform instructors of any physical limitations, injuries, or health concerns before participating.

6.3 Medical Emergencies

• Basic first aid is available on-site
• Serious medical issues will be referred to local medical facilities
• Guests are responsible for all medical costs not covered by insurance
• Emergency evacuation insurance is recommended

7. Guest Responsibilities and Conduct

7.1 Respectful Behavior

Guests are expected to:

• Treat staff, instructors, and other guests with respect and kindness
• Maintain the peaceful and sacred atmosphere of our retreats
• Follow retreat schedules and guidelines
• Respect local customs and cultural practices
• Keep noise levels appropriate for a wellness environment

7.2 Prohibited Items and Activities

• Illegal drugs and excessive alcohol consumption
• Smoking in designated non-smoking areas
• Disruptive behavior that affects other guests' experience
• Use of electronic devices during mindfulness and meditation sessions
• Photography of other guests without consent

7.3 Removal from Program

We reserve the right to remove guests who violate these terms, engage in disruptive behavior, or pose a risk to themselves or others. No refund will be provided for early departure due to misconduct.

8. Accommodation and Meals

8.1 Accommodation Standards

• Accommodations range from shared dormitories to private villas
• All accommodations meet basic comfort and safety standards
• Room assignments are made based on booking type and availability
• Special requests are accommodated when possible but not guaranteed

8.2 Dietary Services

• Meals focus on fresh, organic, and locally-sourced ingredients
• Vegetarian and vegan options are available
• Special dietary requirements must be communicated at booking
• Alcohol may be available but is not emphasized in our wellness programs

9. Liability and Insurance

9.1 Limitation of Liability

Philippines Wellness Retreats acts as an organizer of wellness programs and experiences. We are not liable for:

• Personal injury or illness during retreat participation
• Loss or damage to personal property
• Delays or cancellations due to weather, natural disasters, or government actions
• Actions or services provided by third-party suppliers
• Pre-existing medical conditions or injuries

9.2 Insurance Requirements

All guests are strongly encouraged to obtain comprehensive travel insurance covering:

• Medical emergencies and evacuation
• Trip cancellation and interruption
• Personal property loss
• Adventure activity coverage

10. Intellectual Property

10.1 Company Content

All content on our website, including text, images, videos, logos, and program materials, is protected by copyright and trademark laws. Unauthorized use, reproduction, or distribution is prohibited.

10.2 Guest Content

By sharing photos, testimonials, or other content related to your retreat experience, you grant us permission to use such content for marketing and promotional purposes.

11. Privacy and Data Protection

12. Force Majeure

We are not liable for delays, cancellations, or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:

• Natural disasters (typhoons, earthquakes, volcanic eruptions)
• Government actions or travel restrictions
• Pandemics or health emergencies
• War, terrorism, or civil unrest
• Strikes or labor disputes
• Technical failures or internet outages

13. Governing Law and Disputes

These Terms are governed by the laws of the Republic of the Philippines. Any disputes arising from these Terms or your use of our services shall be resolved through:

• First, good faith negotiation between the parties
• If necessary, binding arbitration in Makati City, Philippines
• Philippines courts shall have exclusive jurisdiction for any legal proceedings
